Understanding Ohio's New OVI Laws: What You Need to Know

Effective April 9, 2025, Ohio enacted sweeping changes to its Operating a Vehicle Impaired (OVI) laws through House Bill 37, commonly known as “Liv’s Law.” This legislation is named in honor of Olivia Wright, a young woman tragically killed by a drunk driver, and is designed to strengthen penalties and improve enforcement of impaired driving offenses across the
state.

Key Provisions of Liv’s Law
1. Increased Financial Penalties
Liv’s Law significantly raises the minimum fines for OVI convictions:
First Offense: Increased from $375 to $555
Second Offense: Increased from $525 to $715
Third Offense: Increased from $550 to $1,040
Fourth or Subsequent Offense: Increased from $1,350 to $1,540
However, the license reinstatement fee has been reduced from $475 to $315.
2. Mandatory Ignition Interlock Devices (IID)
The law now requires certain first-time offenders and all second-time offenders to install an IID—an in-vehicle breathalyzer that prevents the car from starting if alcohol is detected.
3. New Oral Fluid Drug and Alcohol Testing
Law enforcement officers are now authorized to collect oral fluid samples during traffic stops. Refusing to provide a sample carries the same consequences as refusing a breath or blood test.
4. Harsher Penalties for Aggravated Vehicular Homicide
Penalties for impaired drivers convicted of aggravated vehicular homicide have increased to a maximum of 20 years in prison and fines of up to $25,000.
5. Changes to Administrative License Suspensions (ALS)
First-time offenders may now obtain limited driving privileges more quickly, especially if an IID is installed. Repeat offenders face extended suspension periods and mandatory IID installation.
