Am I entitled to my ex-spouse's social security benefits in an Ohio divorce?

You may claim social security benefits based on your ex-spouse's work record if the following criteria are met:

  1. You were married to each other for at least 10 years;

  2. You are no longer married;

  3. You are 62 years old or older;

  4. Your ex-spouse is entitled to social security retirement or disability benefits; and

  5. If you are entitled to benefits on your own, your benefit must be less than the amount you would receive.
